Doing business in Morocco

Groundbreaking ruling by Zurich’s High Court

Groundbreaking ruling by Zurich’s High Court : Credit Suisse must release all personal data to customers

The High Court of Zurich, Switzerland, has recently approved the appeal of two bank customers, represented by Bader ▪ Gnehm & Partner, LAWorld’s Swiss member firm,  against Credit Suisse and ruled that Credit Suisse must release information about all bank-internal personal data about these bank customers.

It is the first time that a court in Switzerland has ruled that a bank has to provide information under the Data Protection Act (DPA) and the court’s ruling is of essential importance to the relationship between bank customers and banks.  The right to information, which is a central instrument of data protection, is a long-awaited breakthrough.

Banks are now obliged to provide information on all person-related data in their internal database, the ‘Client Relationship Management '(CRM) system. The CRM is a comprehensive electronic data collection in which banks record all customer-relevant information (such as risk- and investment profiles, all communication with the customers, assessments of customers and financial transactions).

The courts’ verdict commits banks to more transparency vis-à-vis their customers and puts an end to the current practice, whereby bank-internal personal data was released at the mere discretion of the banks.

London LAWorld firm welcomes three new Directors

Gates and Partners, the LAWorld member firm in Central London, England is delighted to announce that several new lawyers have joined their commercial, aviation and aerospace practice at their offices in London, Singapore and Dubai.

Jeremy Robinson has joined the London office as a Partner to head up the competition practice. Jeremy specialises within the aviation, aerospace & defence and travel industries. Recent matters he has handled include airline predatory pricing, airport charging, scarce bilateral capacity, ATOL renewal, multi-jurisdictional merger control and the EU Defence Procurement package.  Alok Gangola is a corporate transactional lawyer specialising in M&A, private equity and other debt and equity fundraisings who has joined the firm’s corporate finance department as a Partner together with Frans Post who has joined as Chief Financial Officer.
