The EU Regulation n. 679/2016 – the so-called “GDPR” General Data Protection Regulation, concerning the protection of natural persons about the processing of personal data and the free movement of such data –– shall become effective in all EU Client Member States since next 25th May 2018. Therefore, existing Client Member State rules on personal data protection, issued in accordance with the previous Directive 95/46/EC on the same topic, shall be amended accordingly.
The Regulation confirms the main principles set by the 1995 Directive, and also adds new principles and rules, such as, among all, the innovative principle of data accountability, which implies that data should be protected since the determination of the means for processing (data protection by design) and at the time of the processing itself (data protection by default).
The GDPR applies to all companies processing and holding personal data of Data Subjects residing in the European Union, regardless of the company’s location, as well as to organizations located outside of the EU, if they offer goods or services to EU Data Subjects or if they monitor their behavior.
All interested entities need to be privacy compliant, according to the rules established by the Regulation and the Client Member State’s implementing acts, within the deadline of 25th May 2018. In the event of breach of Regulation’s rules, the violator can be fined up to 4% of its annual global turnover or up to € 20 million, beyond the duty to compensate possible damages to Data Subject and other administrative or criminals penalties that the Client Member States are free to establish.
New GDPR rules will have a significant impact on internal organization of companies and entities all around Europe (and not only) regarding data protection policies and duties. For this reason, inside LAWorld network a group of professionals belonging to different jurisdictions all over the world, with specific expertise in data protection law, established the “General Data Protection Regulation Working Group” to share their expertise and knowledge on the EU Regulation and the internal rules.
The GDPR Working Group can provide consistent and qualified joint services to multinational companies located in different EU Client Member States or located outside EU but subject to GDPR rules, assisting them regarding the compliance with the new data protection Regulation and the different Client Member States’ rules.
